Strategic Trust Administration: Addressing Beneficiary Concerns and Strengthening Governance

We advised in relation to a family trust established to provide long-term financial security for future generations. Over time, concerns were raised of the trustees by a primary beneficiary regarding transparency in asset management and the timing of distributions to them.

At the same time, an external representative acting for a longer term beneficiary questioned whether the trust was being administered in full compliance with its governing documents and regulatory requirements.

Without intervention, the situation carried a real risk of escalation into dispute between the trustees and beneficiaries.

How we supported the trustees

We provided strategic advice to stabilise the position and reinforce confidence in the trust’s administration, including:

  • Conducting a detailed review of the original trust deed and any supplemental deeds and documents
  • Clarifying the roles, duties and decision-making responsibilities of the trustees
  • Addressing the primary beneficiary’s concerns through structured, transparent communication
  • Responding to the longer term beneficiary’s queries to demonstrate compliance and reduce the risk of challenge
  • Advising on governance improvements to support ongoing administration

As a result, concerns were resolved without the need for formal dispute proceedings, and the trustees were able to move forward with greater clarity, improved processes and reduced risk.
